4.1.2 Commonwealth assessments
(a) If the nature or location of the site raises the prospect that the project may impact on matters of national environmental significance under the Environment Protection and Biodiversity Conservation Act 1999 (Cth),9 government may refer the project to the relevant Minister for determining whether it is a controlled action and, if so, submit the project for assessment under that Act.
(b) Any further assessment that may be required under that Act as a result of the private party's design solution must be obtained by the private party.
